Check Lottery App Terms and Conditions, Privacy Policy

 

A.        General Terms and Conditions

Please read all of the Terms and Conditions. Only use this “Check Lottery” application (the “App”) if you agree to the Terms and Conditions. By using the App you agree to these Terms and Conditions.

The App contains information related to state lottery drawings. Players must be at least 18 years old to play lottery games. The only official winning numbers are the numbers actually drawn and information should always be verified before it is used in any way.

You affirm that you are 18 years of age or older and are fully able and competent to enter into, abide by and comply with the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. By using any portion of the App, you accept all of the Terms. If you do not agree and accept these Terms without limitation or qualification, please delete the App.

Change, Suspension or Termination: We reserve the right, at our sole discretion, to change, suspend or terminate your use of the App at any time for any reason (including, without limitation, if we learn that you have violated these Terms) without notice to you. You agree that we shall not be liable to you or to any third party for any change, suspension of termination of your use of the App or the services, products and information on the App.

The Terms and all other policies and notices on the App, as well as your use of the App are governed by the laws of the State of Maryland. You expressly agree that exclusive jurisdiction for any claim, dispute, action, or proceedings with the App or relating in any way to your use of the App instituted by you resulting from, arising out of, relating to or in connection with use of this App, the information, products and services provided on this App or these Terms resides exclusively in the State courts located in Montgomery County, Maryland, United States of America. You further agree and expressly consent to the exercise of personal jurisdiction in the courts of Maryland in connection with any such dispute, including any claim involving Techizon or any of their affiliates, subsidiaries, employees, officials, contractors, officers, directors, vendors and content providers.

B.        Limitation of Liability

You agree that your use of the App shall be at your sole risk. Techizon, LLC (“Techizon” or “Company”) shall not be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the App, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the App, (iv) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the App by us or any third party or any other way, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the App online network , whether based on warranty, contract, tort, or any other legal theory, and whether or not the Techizon is advised of the possibility of such damages. The foregoing Limitation of Liability shall apply to the fullest extent permitted by law.

C.        Disclaimer of Liability and Endorsement

 Under no circumstances, including Techizon’s negligence or the negligence of its agents and employees, shall Techizon be liable for any damages of any kind, whether direct, indirect, incidental, special, punitive, consequential, or other damages, including costs, expenses (including attorneys’ fees), liabilities, and losses of any kind whatsoever that may result from the use or inability to use the App online network, including without limitation, use of or reliance on information available on the App, interruptions, errors, defects, mistakes, omissions, deletions of files, delays in operation or transmission, non-delivery of information, disclosure of communications, or any other failure, action, inaction, or performance. Techizon does not warrant that any information on the App is complete or accurate, or that the App will be uninterrupted or error free. Techizon MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS, FOR A PARTICULAR PURPOSE OR ASSUMED LIABILITY FOR THE ACCURACY, COMPLETENESS OR USEFULNESS OF INFORMATION FROM THIS APP OR ANY LINKS TO OTHER SITES OR SERVICES.

D.        Disclaimer of Warranties

TECHIZON MAKES NO WARRANTY OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, ABOUT , THE SUITABILITY, RELIABILITY, AVAILABILITY, QUALITY, MERCHANTABILITY, FITNESS, CONTENT, CURRENCY, TIMELINESS, ACCURACY, COMPLETENESS, USEFULNESS, FREEDOM FROM COMPUTER VIRUS, OR NON-INFRINGEMENT OF PROPRIETARY RIGHTS of any of the design, content, information, text, graphics, images, pages, interfaces, links, software, or other materials and items contained in or displayed on the App. All such items and materials are provided on an “AS IS” basis, and you are fully and solely responsible for your use of them and for any results or consequences of your use (any individual utilizing the App is referred to herein as “User”, “Users”, “you”, or “your”).  YOUR USE OF THE APP IS AT YOUR OWN RISK. Commercial use of any content or information on the App is prohibited without the prior written permission of Techizon.

Any reference obtained from the App to a specific company, commercial product, process, service, or link does not constitute or imply an endorsement, recommendation, or favoring by the Techizon of the company, commercial product, process, service or link.

Techizon may at any time, and without notice, revise any of the policies, notices and/or Terms on the App. You are bound by any such revisions. Therefore, you should periodically visit and review the current Terms and Conditions.

Events Beyond Control. Under no circumstances shall Techizon be held liable for any delay or failure of this App or of the services, products and information on this Site directly or indirectly resulting from, arising out of, relating to or in connection with events beyond our reasonable control, including, without limitation, Internet failures, equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, acts of God, war terrorism, intergalactic struggles, governmental actions, orders of courts, agencies or tribunals or non-performance of third parties. The provisions of this paragraph are in addition to, and not intended to limit or modify, the limitation of liabilities provisions of these Terms.

E.         Indemnification and Release

You, on behalf of yourself, your spouse, your partner, anyone relying on you for support, anyone entitled to act on your behalf, as well as your legal representatives, personal representatives, executors, heirs, administrators, assigns, and insurers, hereby expressly release and discharge Techizon from, and waive as against Techizon, and agree to defend, indemnify and hold harmless Techizon, Techizon’s affiliates, and their respective directors, officers, employees, independent contractors, agents, and other representatives for, from and against any and all claims, demands, suits, and causes of action, for any and all losses, liabilities, costs, expenses, and damages of any kind, whether direct, indirect, incidental, special, punitive, or consequential, liabilities, costs, expenses, obligations, and/or debt, including damage to property, personal injury, and death, and other damages (including but not limited to attorney’s fees) directly or indirectly resulting from, arising out of, relating to or in connection with: (i) your use of and/or access to the App; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; and/or (iv) any claim that one of your User Submissions caused damage to a third party. This paragraph is intended to be applicable to the maximum extent allowed by law. This waiver and release, defense and indemnification obligation will survive these Terms, the App, and Techizon.

F.         Miscellaneous

Techizon reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms, in whole or in part, at any time, which shall be effective when notice of such is posted on this App. Your continued use of this App after such posting shall be considered acceptance of those changes, modifications, additions or removals. These Terms constitute the entire agreement between you and Techizon in connection with your use of the App and the information, products and services provided on App, except for any additional terms and conditions for which you will be notified or prompted by this App that you are agreeing to before proceeding. Any cause of action you may have with respect to use of the App or the information, products and services provided on the App must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of these terms to be unenforceable, then such provision shall be enforced to the maximum extent permissible by law so as to effect the intent of these Terms and the remainder of these Terms shall continue in full force and effect.

G.        Advertisements and Links to Third-Party Sites

Any advertisement inked sites within the App are not under the control by the App, and Techizon is not responsible for the contents, privacy practices, or security of any linked site or any link contained in a linked site, or any changes or updates to such sites. Techizon is not responsible for webcasting or any other form of transmission received from any linked site. The App is providing these links to you only as a convenience; the inclusion of any link does not imply endorsement by any of Techizon or any of the App of any content, or of any products, or services available, on any linked sites. If you establish a link to the App or to any linked sites, you do so at your own risk.

H.        Survival of Terms

In the event of any termination of these Terms, then the following terms shall survive indefinitely: proprietary rights, disclaimers, limitation of liabilities, events beyond control and indemnification provisions and paragraphs set forth above; other provisions noted above or elsewhere in the Terms as surviving; and this paragraph.

Techizon, LLC (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit the our application (“App” or “Application”). Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

COLLECTION OF YOUR INFORMATION

We may collect information about you in a variety of ways. The information we may collect via the Application depends on the content and materials you use, and includes:

Personal Data

Demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application, such as chat, posting messages in comment sections or in our forums, liking posts, sending feedback, and responding to surveys. If you choose to share data about yourself via your profile, online chat, or other interactive areas of the Application, please be advised that all data you disclose in these areas is public and your data will be accessible to anyone who accesses the Application.

 

 

Derivative Data

Information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, including liking, re-blogging, or replying to a post, as well as other interactions with the Application and other users via server log files.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Application. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Apple, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

 

Geo-Location Information

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s Camera to take lottery picture. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data

Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

Push Notifications

We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Third-Party Data

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Application permission to access this information.

Data From Contests, Giveaways, and Surveys

Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

 

USE OF YOUR INFORMATION

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Application to:

  2. Assist law enforcement and respond to subpoena.

  10. Increase the efficiency and operation of the Application.

  13. Offer new products, services, mobile applications, and/or recommendations to you.

  15. Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.

Offer Wall

The Application may display a third-party-hosted “offer wall.” Such an offer wall allows third-party advertisers to offer virtual currency, gifts, or other items to users in return for acceptance and completion of an advertisement offer. Such an offer wall may appear in the Application and be displayed to you based on certain data, such as your geographic area or demographic information. When you click on an offer wall, you will leave the Application. A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account.

Social Media Contacts

If you connect to the Application through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity.

Other Third Parties

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

TRACKING TECHNOLOGIES

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Application to help customize the Application and improve your experience. The Application may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Application, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

SECURITY OF YOUR INFORMATION

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

POLICY FOR CHILDREN

We do not knowingly solicit information from or market to children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us using the contact information provided below.

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Application, you have the right to request removal of unwanted data that you publicly post on the Application. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Application, but please be aware that the data may not be completely or comprehensively removed from our systems.
